Becoming an Australian Citizen (by Birth) is a common way to become an Australian Citizen. There are also numerous ways where an Australian-born individual automatically becomes an Australian Citizen the day they are born.

In this page, we will only discuss the option of a non-Australian being born in Australia to temporary residents or unlawful residents, and in what circumstances they can receive an Australian Citizenship Certificate on their 10th birthday or if they were born on or after the 1st of July 2022 and at least one of their parents was a Citizen of New Zealand and a holder of a Special Category Visa (Subclass 444).

Once an Applicant has officially become an Australian Citizen, they will be able to get an Australian Passport and vote in elections, among other benefits.

ELIGIBILITY

To be eligible to apply for a Citizenship Certificate (on or after their 10th Birthday), the Applicant must:

Have been born in Australia.
Have been ordinarily a resident of Australia for the first 10 years after they were born.
Prove that they were ordinarily a resident of Australia during this time.

To be eligible to apply for Citizenship by Birth* (if their parent was a Citizen of New Zealand on the day they were born), the Applicant must:

Have been born in Australia.
Have been born on or after the 1st of July 2022.
Have had at least one parent in Australia at the time they were born, and that parent must have been a Citizen of New Zealand and the holder of a Special Category Visa (Subclass 444).

*This pathway will be available on the 1st of July 2023.

AFTER THE CITIZENSHIP LODGEMENT

After lodgement, the Applicant will receive an Acknowledgement letter, and they will remain on their current Visa until a decision is made. Bridging Visas are not granted for the Citizenship categories.

Approximate Processing Time for a decision: The DHA’s indication is between 1 week and 1 month for a decision. However, this changes on a monthly basis.

Frequently Asked Questions (Citizenship by Birth)

If someone is born in Australia and at least one of their parents is an Australian Citizen or Australian Permanent Resident, do they need to provide all this same evidence?

No.

You can apply for proof of Citizenship if you were born in Australia on or after 20 August 1986 and at least one of your parents was an Australian Citizen or Permanent Resident when you were born.

Does a Citizenship (by Birth) Applicant need to meet the General Residence Requirements and/or sit the Citizenship Test?

No. The General Residence Requirements and successful completion of the Citizenship Test only applies to Citizenship (by Conferral) Applications.

How does an Applicant prove that they were 'ordinarily' a resident of Australia for the first 10 years after they were born?

The Applicant will need to provide a satisfactory combination of the following documents:

Their Current Passport.
Their Previous Passports.
Their Birth Certificate.
Evidence of their Travels for the first 10 years after they were born.
Evidence of their Parent's Visas for the first 10 years after the Applicant was born.
Evidence of their Parent's Travels for the first 10 years after the Applicant was born.
School Records up to the age of 10.

Additional documents may be required, depending on how many of the abovenamed documents were provided.

Does the Applicant need to provide their Criminal Records?

No. Providing Criminal Records is not required for Citizenship (by Birth) Applications.

Does the Applicant need to undertake a Health Examination?

No. Health Examinations are not required for Citizenship Applications.

Does the Applicant lose their current Citizenship if they become an Australian Citizen?

Australia does not require new Australian Citizenship Applicants to renounce their current Citizenship.

Whether an Applicant loses their current Citizenship when they become an Australian Citizen does not depend upon Australian Citizenship law, but upon the Citizenship laws of the other country.

A number of countries allow their citizens to keep their original Citizenship.

We recommend that all prospective Australian Citizenship Applicants contact their nearest Consulate or Embassy to get the latest information.

What are the most common reasons for Citizenship (by Birth) application refusals?

The 3 most common reasons for Citizenship (by Birth) application refusals are as follows:

Failure to provide evidence of the Applicant's residency during the first 10 years of their life.
Failure to respond to Requests for More Information (RFIs) from the Department of Home Affairs (DHA).
Failure to prove the Identity Requirements.
