The Administrative Review Tribunal (A.R.T.) is an Australian Tribunal that conducts independent merits review of administrative decisions made under Commonwealth laws of the Australian Government. 


If you have received a Visa Refusal or Cancellation, you may have the right to appeal the decision to the Administrative Review Tribunal (A.R.T.). Once the appeal has been lodged (and as long as it was a valid appeal application), you will need to await for further instructions from the Tribunal.


Usually, there will be an invitation to provide additional information and an invitation to a Tribunal Hearing. If you do not provide the additional information the Tribunal has requested, you may lose your right to a Tribunal Hearing to plead your case.


The Administrative Review Tribunal (A.R.T.) replaced the Administrative Appeals Tribunal (A.A.T.) on the 14th of October 2024.


Preparing a response to the additional information invitation, preparing for the Tribunal Hearing and most importantly, providing the best possible case at the actual Hearing can be daunting and overwhelming.

Overview

Andreas Athanasiou has attended numerous Tribunal Hearings covering a range of different visa subclasses, with an outstanding success record. We can assist you in any of the following Tribunal-related matters:


• Lodging the Appeal to the Tribunal.

• Providing thorough submissions to the Tribunal (before and after they request any information).

• Preparing you for the Tribunal Hearing (at least 2-3 mock interviews in our Office or over Zoom).

You must pay an Tribunal appeal fee if you lodge an application for a review of most migration decisions.


The Appeal fee is $3,496 and must be paid before the deadline for applying for Review to the A.R.T.


In some cases, the Appeal fee can be reduced by 50% if you are able to prove that paying the full fee would cause you severe financial hardship. 


 If your appeal is successful, the Tribunal will refund you 50% of the full fee (if you have paid the full fee).

Tribunal PROCESSING TIMES

The time it takes for the Tribunal to complete the Appeal process depends on a range of factors, including:


• The number of applications they have received.

• The number of Members available at the time.

• The type of decision under appeal.

• The complexity of the case.


The average timeframe for a decision at the moment to finalise a review depends on the complexity of your case. The expected processing times are:

• Work-related Applications: 2 to 4 years.

• Family-related Applications: 2 to 6 years.

• Refugee-related Applications: 5 to 7 years.

• Average across all Applications: 1 to 5 years.

 
Cases that lack merit and are straightforward may be resolved within a few weeks or months.

Frequently Asked Questions (Refusals & Tribunal Matters)

Not all application refusals provide the opportunity for a Merits Review. The Decision Record will state whether that decision can we appealed.


For the Visas that can be appealed, the Tribunal usually allows 21 or 28 calendar days to appeal a decision.


In some case it may be less or more than that, depending on the policy.


Usually an Appeal Acknowledgement will be received within 1 to 5 business days. 


In some cases, it may take longer. In other cases, the appeal application may have been deemed invalid.


There are a number of factors on why an appeal application may be deemed invalid. It is recommended that you appoint an experienced Registered Migration Agent to appeal on your behalf.

It depends on the complexity of the case. If the appeal has no chance of being overturned, then a decision may be made within a matter of weeks.

The Tribunal Hearing can take place in any of the following formats:

  • Face-to-Face at an A.R.T. Office.
  • Video Conference.
  • Phone Conference Call.


The majority of Tribunal Hearings go for 2 to 3 hours, depending on the case.


In some rare instances, they may go for under 1 hour or over multiple days.


A routine Tribunal Hearing will have the following attendees:

  • The Applicant who made the Appeal.
  • The Tribunal Member.
  • An A.R.T. Staff Member.


Other attendees may also include:

  • A Representative, such as a Registered Migration Agent.
  • A support person such as a friend or family member.
  • Any witnesses that the Applicant has asked to give evidence (The Tribunal does not expect it will be necessary to call witnesses in many cases).
  • An Interpreter (if the Applicant requires one).


It depends on the case.


It is highly recommended that you seek a Registered Migration Agent to prepare you for the Tribunal Hearing (with at least 2-3 mock interviews beforehand).


If you go to a Tribunal Hearing unprepared you will minimise the chances of a successful outcome.
