Australian Citizenship (by Birth)
Becoming an Australian Citizen (by Birth) is one of the most common and straightforward pathways to citizenship. In many cases, individuals born in Australia automatically acquire Australian citizenship at birth, depending on the immigration status of their parents.
On this page, we focus specifically on situations where a child is born in Australia to parents who are temporary residents or unlawful non-citizens, and the circumstances under which that child may be eligible to receive an Australian Citizenship Certificate on their 10th birthday.
Once citizenship is granted, individuals are entitled to apply for an Australian passport, vote in Australian elections, and enjoy the full rights and privileges of Australian citizenship.

Eligibility
This category applies to children born in Australia where neither biological parent was an Australian citizen nor an Australian permanent resident at the time of the child’s birth. Applications are assessed in accordance with the Australian Citizenship Act 2007 and the Australian Citizenship Regulations 2016, including the provisions relating to citizenship by birth and long-term residence. To be eligible to apply for Australian citizenship on or after their 10th birthday, an applicant must generally:
Have been born in Australia.
Have been an ‘ordinary resident’ in Australia for the first 10 years of their life. This is the hardest criterion to meet.
Provide evidence of continuous residence during that period.

Application Charges
The Department of Home Affairs (DHA) charges AUD $280 for an Australian Citizenship (by Birth) application.
Applicants should also be aware of potential additional expenses, which may include:

Certified translations of documents (if required).
Bank or credit card surcharges.

After the Citizenship Lodgement
Once the application is lodged, the applicant will receive an Acknowledgement Letter from the Department of Home Affairs.
They will remain on their current visa until a decision is made (if they are onshore), as Bridging Visas are not issued for citizenship applications. If their current visa is expiring, they must apply for another visa to remain in Australia lawfully.
If the applicant receives confirmation of Australian citizenship, the applicant becomes eligible to apply for an Australian passport.
If the applicant is 18 years or older, they are required by law to enrol to vote, which enables them to participate in federal, state, and local elections and referendums.
