Skills in Demand Visa (SID) (Subclass 482)
The Skills in Demand Visa (Subclass 482) allows skilled workers to live and work in Australia for up to four years when sponsored by an eligible Australian employer.
The process involves three key stages: the employer becoming an approved Standard Business Sponsor, the nomination of a genuine position, and the lodgement of the visa application by the worker. In some circumstances, holders of this visa may later become eligible to transition to permanent residence through the Employer Nomination Scheme (Subclass 186).
Applications are assessed in accordance with the Migration Act 1958 and the Migration Regulations 1994, including the nomination and visa criteria set out in Schedule 2 of the Regulations, which require the position to be genuine, the applicant to be suitably skilled and experienced for the nominated occupation, and the sponsoring employer to meet ongoing sponsorship and compliance obligations.
Employer Nomination Scheme Visa (ENS) (Subclass 186)
The Employer Nomination Scheme Visa (Subclass 186) allows skilled workers to live and work in Australia permanently when sponsored by an eligible Australian employer.
The process involves the employer nominating a genuine position and the applicant meeting the relevant visa requirements, with eligibility available under both the Temporary Residence Transition stream for applicants who have worked for their nominating employer on a Skills in Demand visa (Subclass 482), and the Direct Entry stream for applicants who qualify for permanent residence without holding a prior relevant Visa.
Applications are assessed in accordance with the Migration Act 1958 and the Migration Regulations 1994, including the nomination and visa criteria set out in Schedule 2 of the Regulations, which require the position to be genuine, the applicant to be suitably skilled and experienced for the nominated occupation, and the sponsoring employer to meet sponsorship and compliance obligations.
Information for Employer/Sponsors
Australian employers and corporations may sponsor or nominate overseas skilled workers for either temporary or permanent work visas.
Sponsoring a worker who is not an Australian citizen or permanent resident is a significant commitment, with eligibility dependent on the business demonstrating a genuine need for the role, skills shortages within the local labour market, and the financial capacity to meet its obligations. As employer sponsorship involves complex legal requirements and strict eligibility criteria, obtaining professional advice before proceeding is essential.
Employer sponsors must comply with the Migration Act 1958 and the Migration Regulations 1994, including meeting sponsorship and nomination requirements, maintaining lawful employment arrangements, and fulfilling all ongoing compliance and sponsorship obligations for the duration of the sponsored employment.
Skilled Independent Visa (Subclass 189)
The Skilled Independent Visa (Subclass 189) allows invited skilled workers in occupations identified as being in demand in Australia to live and work permanently anywhere in the country.
Applicants must first submit an Expression of Interest (EOI) to the Department of Home Affairs and, if invited, may then apply for the visa. This is a points-tested visa, with invitations issued based on factors such as age, qualifications, skilled employment, and English language proficiency.
Applications are assessed in accordance with the Migration Act 1958 and the Migration Regulations 1994, including the visa criteria set out in Schedule 2 of the Regulations, which require the applicant to obtain a positive skills assessment, satisfy English language and points-test thresholds, and nominate an occupation on the relevant skilled occupation list.
Skilled Nominated Visa (Subclass 190)
The Skilled Nominated Visa (Subclass 190) allows invited skilled workers in occupations identified by an Australian State or Territory government to live and work permanently in Australia.
Applicants must first submit an Expression of Interest (EOI) through the Department of Home Affairs, indicating their preferred State or Territory, and if nominated and invited, may then apply for the visa.
