Partner Visa Pathways Olympus Migration

There are three visa options for couples wishing to begin their lives together in Australia, free from the stress and uncertainty of immigration matters.

It is important to distinguish between the two parties involved. The overseas partner is the Applicant, while the Australian citizen, permanent resident (PR), or eligible New Zealand citizen (eNZC) is the Sponsor.

There is one onshore option (where the Applicant can remain in Australia during processing) and two offshore options (where the Applicant applies from overseas).

Onshore Partner Visa (Subclass 820/801)

The onshore Partner Visa (Subclass 820) allows the partner of an Australian citizen or an Australian permanent resident to live in Australia temporarily, with a pathway to permanent residency (Subclass 801).

Applicants must be in Australia at the time of lodgement and be married or in a genuine de facto relationship with their partner, even if they are living apart.

Applications for this Visa are assessed in accordance with the Migration Act 1958 and the Migration Regulations 1994, including sections 5CB and 5F of the Act, which define de facto and spousal relationships, and regulation 1.15A of the Regulations, which prescribes the mandatory factors the Department must consider when determining whether a relationship is genuine and continuing.

Offshore Partner Visa (Subclass 309/100)

The offshore Partner Visa (Subclass 309) allows the partner of an Australian citizen or an Australian permanent resident to live in Australia temporarily, with a pathway to permanent residency (Subclass 100).

Applicants must be outside Australia at the time of lodgement and be married or in a genuine de facto relationship with their Australian partner, even if they are living apart.

Applications for this Visa are assessed in accordance with the Migration Act 1958 and the Migration Regulations 1994, including sections 5CB and 5F of the Act, which define de facto and spousal relationships, and regulation 1.15A of the Regulations, which prescribes the mandatory factors the Department must consider when determining whether a relationship is genuine and continuing.

Offshore Prospective Marriage Visa (Subclass 300)

The offshore Prospective Marriage Visa (Subclass 300) allows the fiancé of an Australian citizen or an Australian permanent resident to live in Australia temporarily for the purpose of marriage.

Applicants must be outside Australia at the time of lodgement. Once granted, they may enter Australia, marry their sponsor, and later apply for the onshore Partner Visa (Subclass 820/801).

Applications for this Visa are assessed in accordance with the Migration Act 1958 and the Migration Regulations 1994, including the Schedule 2 criteria applicable under the Regulations, which require the Department to be satisfied that the parties have met in person, genuinely intend to marry and live together as spouses, and are in a genuine and continuing relationship, with the assessment of the relationship undertaken by reference to factors consistent with regulation 1.15A of the Regulations.
